It is rare for the United States Supreme Court to reassess a case, but an exception is made for that case. In 2013, Tsarnaev and his brother committed a bloody attack at the finish of the Boston Marathon. Homemade bombs in a pressure cooker killed three people and injured more than 260 people.
Tsarnaev was arrested a few days later. Her brother had already died in a shootout with the police.
Appeal
In 2015, the Kyrgyz American was sentenced to death, but dismissed on appeal. The jury would not have been impartial, so the case had to be reconsidered. President Trump’s Justice Department has appealed, seeking a judgment from the Supreme Court, the highest court in the United States.
This judgment is now coming, making the death sentence possible from 2015. The other option is for the Supreme Court to accept the decision on appeal, thus ruling that the case should be considered by a lower court.
The surviving relatives do not have to fear being released: whatever the decision of the Supreme Court, the life sentence will remain in all cases. The decision is expected in June 2022.
